By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including the additional policies referenced herein and available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products to you.

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use this site.

You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer.

SECTION 3 - ACCURACY OF INFORMATION ON THIS SITE
General information on this site, such as educational blog content, is provided for reference only. We may update the contents of this site at any time. Product-specific details are addressed in Section 4.
SECTION 4 - OUR PRODUCTS AND PRODUCT IMAGES
We describe our metals, gemstones, and measurements as accurately as possible. Natural gemstones are unique and vary in color, clarity, and inclusions. Carat weights and measurements may vary slightly within standard industry tolerances. Colors may appear differently depending on your screen and device settings.
Product photos may be retouched for lighting, background, and clarity, and some images, including certain renderings of made-to-order designs, are created with the help of AI tools to show how a piece will look. Natural gemstones vary, and your piece may differ slightly from the images shown. If you’d like additional photos or video of any piece before purchasing, please contact us at sara@headfoundjewelry.com and we’ll be happy to provide them.
Certain products may be available in limited quantities or as one-of-a-kind pieces. All products are subject to return or exchange only according to our Return Policy: https://headfoundjewelry.com/policies/refund-policy
We reserve the right to limit the sale of our products to any person, geographic region, or jurisdiction, to limit quantities, and to discontinue any product at any time. Product descriptions and pricing are subject to change without notice. Any offer for any product made on this site is void where prohibited.
SECTION 5 - PRICES, PROMOTIONS, AND MODIFICATIONS TO THE SERVICE
Prices for our products are subject to change without notice. The price charged will be the price in effect at the time your order is placed. Unless otherwise stated, posted prices do not include taxes, shipping, customs, or import charges.
Promotions and giveaways are governed by their own terms or official rules, which will be posted separately. If a promotion’s terms conflict with these Terms, the promotion’s terms will govern for that promotion.
We reserve the right to modify or discontinue the Service (or any part of it) at any time without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
SECTION 6 - CUSTOM AND MADE-TO-ORDER PIECES
Custom Pieces
Custom orders are paid in three installments:
- Stone sourcing deposit: A non-refundable deposit of $1,500 is due before we begin sourcing stones and design work. This deposit is applied toward the total price of your piece.
- Second payment: 50–75% of the remaining balance is due upon your written approval of the final design, before production begins.
- Final payment: The remaining balance is due before your piece ships or is picked up.
Production begins only after you approve the final design in writing and the second payment is received. Once production begins, custom orders cannot be cancelled, and payments made are non-refundable. Estimated production time is 8–10 weeks from design approval. This timeline is an estimate and is not guaranteed.
Made-to-Order Pieces
Made-to-order pieces purchased through our online store are paid in full at checkout and cannot be cancelled once production begins. Estimated production time is 8–10 weeks from the order date and is not guaranteed.
Sizing
Please confirm your ring size before ordering. We offer one complimentary resize within 60 days of delivery for made-to-order rings. Additional resizing may incur a fee. Some designs, including certain one-of-a-kind pieces, may not be resizable.
Heirloom and Customer-Provided Materials
When you provide your own stones, metal, or jewelry for redesign, repair, or resetting, you acknowledge that working with previously owned materials carries risks that we cannot fully control. Stones may have hidden fractures, inclusions, prior treatments, or wear that make them vulnerable to chipping, cracking, or breaking during removal, setting, cleaning, or exposure to heat. Older metals may contain unknown alloys, solder, or porosity that affect how they can be reworked.
We inspect and document all customer-provided materials when we receive them, and we will share any concerns with you before work begins. However, Headfound Jewelry is not responsible for damage to customer-provided materials that results from these inherent risks, or from pre-existing conditions. We do not guarantee the identity, origin, or value of customer-provided stones or metals. If you would like a professional appraisal or gemological report before work begins, we recommend obtaining one independently.
Melted or reworked metal may yield less usable material than its original weight, and some customer-provided metal may not be suitable for reuse. In that case, we will discuss alternatives with you.
SECTION 7 - ORDERS, BILLING, AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. If we change or cancel an order, we will attempt to notify you using the email, billing address, or phone number provided at the time of purchase. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store, and to promptly update your information so we can complete your transactions and contact you as needed.

SECTION 8 - SHIPPING AND DELIVERY
All orders ship with tracking and require a signature on delivery. Delivery times are estimates and are not guaranteed. Your order is our responsibility until it is delivered and signed for; after delivery, Headfound Jewelry is not responsible for lost or stolen items. If a package is lost or damaged in transit, please contact us within 48 hours of the expected delivery date at sara@headfoundjewelry.com. SECTION 9 - OPTIONAL TOOLS
We may provide you with access to third-party tools that we neither monitor nor control. You acknowledge and agree that we provide access to such tools “as is” and “as available,” without any warranties or endorsement, and we shall have no liability arising from your use of them. Any use of optional tools offered through the site is at your own risk.

Third-party links on this site may direct you to websites that are not affiliated with us. We are not responsible for the content or accuracy of third-party websites and will not be liable for any harm or damages related to the purchase or use of goods, services, or content in connection with any third-party website. SECTION 11 - USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS
If you send us creative ideas, suggestions, reviews, photos, or other materials, whether at our request (for example, giveaway entries) or not, you agree that we may edit, copy, publish, distribute, and otherwise use them in any medium without restriction or obligation to compensate you or keep them confidential. We will not publish photos of you or your custom piece without your permission.
You agree that your comments will not violate any third party’s rights, will not contain unlawful, abusive, or obscene material, and will not contain any malware. You may not use a false email address or mislead us as to the origin of any comments. You are solely responsible for any comments you make.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS
Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors and to change information or cancel orders if information is inaccurate, including after you have submitted your order. If we cancel your order due to an error, we will refund any payment received for that order.

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to participate in unlawful acts; (c) to violate any regulations, rules, or laws; (d) to infringe our intellectual property rights or the rights of others; (e) to harass, abuse, defame, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with the security features of the Service. We reserve the right to terminate your use of the Service for violating any prohibited use.

We do not guarantee that your use of our website will be uninterrupted, timely, secure, or error-free.

In no case shall Headfound Jewelry or its contractors, suppliers, or service providers be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Service or any product. Our total liability for any claim related to a product shall not exceed the amount you paid for that product. Because some jurisdictions do not allow the exclusion or limitation of certain damages, our liability in those jurisdictions shall be limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless Headfound Jewelry and its contractors, suppliers, and service providers from any claim or demand, including reasonable attorneys’ fees, made by any third party due to your breach of these Terms or your violation of any law or the rights of a third party.
SECTION 17 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.
SECTION 18 - TERMINATION
Obligations and liabilities incurred before the termination date survive termination. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by ceasing to use our site. If we determine that you have failed to comply with these Terms, we may terminate this agreement without notice, and you will remain liable for all amounts due up to the date of termination.
SECTION 19 - ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of it. These Terms and any policies posted by us on this site constitute the entire agreement between you and us and supersede any prior agreements or communications.
